EVOLUTION OF THE LEGAL STATUS OF MARRIAGE AND DIVORCE IN THE SOVIET PERIOD

Abstract

The article analyzes the evolution of the legal status of marriage and divorce in the Soviet period. The authors, taking into account the opinions of domestic and foreign scientists, the features of the procedure for concluding and dissolving marriages in Soviet times are determined. It is concluded that during the period of Soviet power, marriage and family relations were more imperative in nature, since the state’s control over an important unit of society - the family - was clearly visible. But, despite the existence of such control, the Soviet government played a big role in the establishment of the institution of marriage. The Soviet legal system, step by step, through the adoption of new legal documents and their improvement, had a positive influence on the formation of marriage relations, including the procedure for concluding and dissolving a marriage, thereby protecting marriage as a family and social value. According to the study, the legislator managed to free marriage as much as possible from formalities and turn it into a truly free union of a man and a woman. The powers to register marriages and divorces were completely transferred to the state, and thus marriage was given a secular character.
