ON SOME THEORETICAL PECULIARITIES OF THE ESSENCE OF PROVING IN CIVIL-PROCEDURAL LEGISLATION

Abstract

Proving is one of the main issues of the subject not only of science, but of the branch of civil procedural legislation either. Because establishment of the truth of the case in legal conflict is the ultimate goal of justice as one of the forms of state activity. The author defines the range of subjects of evidence linking with the legal status and functional purpose of the participants in the judicial process, the concept of evidence is connected with its etymological significance. As a result, he proposes cognition as the second form of activity in the process of establishing the actual truth in a case.
