To the Issue Concerned with Classification of Spouses` Right for Property in Zoroastrian, Moslemic and Romanic Laws and their Influence upon Tajikistan Republic Legislation

Abstract

The article dwells on the problems dealing with the definition of the right for property, classification of the rights  of spouses for property in Zoroastrian, Moslemic and Romanic laws in historic aspect; the peculiarities of legal regime of spouses` property in the indicated law systems with effectuation of comparative analysis aimed at classification of properties being taken into consideration as well. The author analyzes the problems of woman`s personal legality in property relations‚ limits of man` power and his duty to support the family materially, the issues associated with the criteria of classification in reference to spouses` rights for property and their types in Zoroastrian, Moslemic and Romanic laws inclusive. Concurrently their comparison with the functioning legislation of Tajikistan Republic is considered. Designing on the premise of the classification in question, the author determines the degree of succession of the norms  in regard to canvassed law system in modern legislation.
