THEORETICAL AND LEGAL ISSUES OF POSITIONING THE ECOLOGICAL FUNCTION OF THE STATE IN THE SYSTEM OF ITS INTERNAL AND EXTERNAL FUNCTIONS

Abstract

The article analyzes theoretical and legal issues concerning the place of the environmental function of the state in the system of its internal and external functions based on modern scientific concepts. In essence, one of the general theoretical problems in legal science is the question of the environmental function of the state, the system of these functions and the place of the environmental function among other state functions. Currently, one of the theoretical problems of an institutional nature that causes controversy among scholars of state and law theory is the question of the place of the environmental function of the state in the system of its internal and external functions. Regarding the classification of state functions, scholarly opinions in this area are varied and there is no consensus. However, it is important to note that the environmental function of the state has strengthened its scientific position as an independent function of the state. New scientific ideas regarding the environmental function of the state are gradually developing in the domestic legal space. The current state of nature and people's attitudes toward environmental protection increasingly compel the adoption of scientific and practical measures and the development of effective mechanisms for implementing the state's environmental function.
