The Tenets of the Koran Related to Forensic Power (historical-legal and theoretical research)

Abstract

The author has explored the forensic tenet of the Koran, that of the paramout classical original of Islamic Law, keeping to grave comprehension in regard to the peculiarities of the Koran, its arising and structure. He draws attention to the legal nature of Koranic suras proceeding from an existence of principles and norms being of forensic importance and permeating the sacred book. Principal normative attitude of the Koran to the issues of just-notions of content and essence, aim and assignment of Koranic principles and norms of forensic importance by means of broad usage of well-known and authentic interpretations of the Koran are well-grounded. The role of the tenet and the traditions of prophet Mukhammad referring to law and justice in a cognition of forensic essence of the Koran, specificities of diverse aspects of the tenet in question touching upon forensic power, their significance for realization of justice and lawfulness – all enumerated items are expounded. It is emphasized especially that this tenet is distinguished with correspondence to norm and obligatoriness.
