DOCTRINAL APPROACH TO THE CLASSIFICATION OF MODERN LEGAL SYSTEMS

Abstract

The article examines the main objects of comparative law: the legal system and the legal family. It explores the concept, characteristics, structure, and approaches to classifying legal systems. The doctrinal approach to classifying legal systems leads to the identification of certain types of legal families. Foreign and Russian scholars have presented the most important positions, based not only on legal and technical factors, but also on specific historical, geographical, spiritual, political, and other factors. The main reason for the differences in approaches to classification criteria lies in the primary emphasis placed on the history of the formation of legal sources, the structure of legal systems, the level of legal consciousness, the status of religious and moral norms, the economic and social status of society, and other factors. It is argued that in the modern period, most countries around the world attach great importance to the field of comparative law, as well as to the study and classification of modern legal systems. The purpose of such research is, first of all, to identify patterns of formation of legal systems, ways of their dissemination and improvement of national legislation. The need to study modern legal systems lies in the fact that it is aimed not only at identifying new problems, such as legal understanding, lawmaking and law enforcement practice, but also at a comprehensive and complete disclosure of legal issues related to customs, traditions, cultural and national characteristics and religious norms of an individual state in the legal map of the world.
