Tajikistan Republic Constitution as the Main Source on Protection of Human Rights and Freedoms

Abstract

The article dwells on the essence of Constitutions as the main legal instrument protecting man’s rights and freedoms in Tajikistan Republic. The author considers an urgency of transition of numerous legal instruments on human rights to their real and universal implementation as one of fundamental assignments of each state. Constitution is revealed as the very essence of the source aimed at a protection of man’s rights and freedoms. Attention is paid to the Constitutional court on human rights advocacy. The author analyzes institutional approach to Constitution as a primary original on human rights protection. He substantiates a special importance of observance and respect of human rights and freedoms which are bound to be taken into consideration by all branches of state power. The role of TR Constitution in human rights protection is underscored, the ways of elevation of its effectiveness are suggested.
