ON THE LEGAL NATURE OF INTERNATIONAL CIVIL PROCEDURE

Abstract

International civil procedure is a set of procedural issues related to the protection of the rights of foreign legal entities and individuals in courts and arbitration tribunals. The author argues that international civil procedure addresses issues such as jurisdiction in civil, labor, and family matters; the status of foreign individuals and legal entities, states, and diplomatic missions; the content of foreign law; and the enforcement of foreign court and arbitration decisions. Based on an analysis of legal literature, the author identifies the key issues requiring separate study as the place of international civil procedure within the system of branches of law and the disciplines of legal science. The conclusion is made regarding the place of international civil procedure as a branch of law and science, that international civil procedure, both in terms of the branch and in terms of science, belongs to the sphere of international private law.
