Abstract

The article examines the linguistic method as a key element of the methodology of legal technique. It explores the components of the linguistic method and elucidates its role within the system of methods of legal technique. Furthermore, it analyzes the law-making practice of the Russian Federation regarding the identification of linguo-legal errors that lead to gaps in the law. The article substantiates the need to formally regulate the role of linguistics specialists in the drafting of legal documents. It examines the structure of the linguistic method within the context of legal drafting techniques and identifies the specific areas of legal practice where this method is most essential. Finally, practical recommendations are offered regarding the application of the linguistic method in legal work. The study establishes that the methodology of legal technique is not identical to the methodology of the general theory of law. It concludes that the linguistic mode of cognition exerts a significant influence on the system of legal technique. The integration of linguistic and formal-logical methods is proposed to minimize legal uncertainty. A hypothesis is advanced regarding the potential convergence of the linguistic mode of cognition with other methods of legal technique, including the logical method.
