The article examines the relationship between the concepts of “offense” and “violation of subjective rights” in the context of the general theory of law, as well as the concept of “subjective right” itself and defines its characteristics.It is substantiated that the violation of subjective rights is not always identical to an offense, since it can express a deviation from the legal status without signs of guilt. A definition of the concept of “violation of subjective rights” is proposed and the difference between an offense and a violation of subjective rights is clarified.
