SOCIAL DETERMINATION OF THE CRIME OF PUBLIC CALLS TO FORCED CHANGE OF THE CONSTITUTIONAL SYSTEM OF THE REPUBLIC OF TAJIKISTAN

Abstract

The article establishes and analyzes the social causality of criminal liability for a public call for a violent change in the constitutional system of the Republic of Tajikistan. It has been suggested that the necessity or social reason for the appearance of Article 307 of the Criminal Code of the Republic of Tajikistan, that is, a public call for a violent change in the constitutional system of the Republic of Tajikistan, stems from several important political, social and security factors, including: a) protection of the constitutional order and state structure; b) ensuring national security and protecting territorial integrity; c) preventing unrest and riots; protection of the rights and freedoms of citizens; d) combating extremism and terrorism; e) historical experience and study of events; f) compliance with international law. These factors are analyzed separately, and proposals for improving Article 307 of the Criminal Code of the Republic of Tajikistan are outlined.
