THE CONCEPT AND ESSENCE OF THE BASIS OF THE CONSTITUTIONAL SYSTEM

Abstract

The article analyzes the concept and essence of the foundations of the constitutional system. Based on the opinions of scientists, the constituent elements of the foundations of the constitutional system are defined: the foundations of the state system and the foundations of the structure of society. The limited and broad concept of the foundations of the constitutional system are explained. It is emphasized that the basic norms of the constitutional structure serve to regulate relations between society and the state, relations of the state with other states, the position of the state in the life of society and the position of the people in the organization of state power. The characteristics of the foundations of the constitutional system are considered and, based on them, the author’s definition of this concept is proposed.
