The article examines the process of integrating women's reproductive rights into the doctrine of "due process" and recognizing the right to privacy as constitutionally protected. Examples of court cases are provided that expand reproductive rights, including the rights to contraception and abortion. Particular attention is paid to the role of the US Supreme Court under the leadership of Warren Earl Berger in the legalization of abortion. Berger's premises contributed to the further liberalization of women's rights and defined the legal framework for abortion for decades. However, 49 years later, the US Supreme Court, citing the Constitution of the country, overturned its own decision in the Roe against Wade case. Thus, the issue of allowing or prohibiting abortion was left to the discretion of the states.
