CONCEPTUAL BASIS FOR THE NEED TO ADOPT THE LAW OF THE REPUBLIC OF TAJIKISTAN «ABOUT CONSUMER LOAN, CREDIT AND FINANCING»

Abstract

In the modern world, consumer credit has become the main type of crediting to natural persons. The word «consumer credit» is found in a number of legislative acts of the Republic of Tajikistan (RT) among banking operations. Within the meaning of Part 7 of Art. 888 and part 2 of Art. 900 of the new Civil Code of the Republic of Tajikistan, legal relations on consumer loans and credit are regulated by a separate law, although such a law has not yet been adopted. Despite the fact that this word appears in the country’s legislation, there is no detailed, legally recorded answer to the question: what is this type of crediting? Therefore, the study of this issue with the aim of developing a concept for the institution of consumer lending has become on the agenda of the Tajik legal doctrine. The article presents the author's concept of the institution of consumer crediting in Tajikistan, taking into account the peculiarities of the country's legislation.
