ESSENCE AND CONTENT OF COMPULSORY WORK AS A TYPE OF CRIMINAL PENALTY

Abstract

The article analyzes the essence and content of compulsory work as a type of criminal penalty.  The opinions of domestic and foreign scientists are presented, legislative norms are studied, the meaning and content of compulsory work are determined. It is concluded that compulsory work as a type of criminal penalty is enshrined in the country’s criminal legislation and has its own content.The content and essence of compulsory work as a criminal penalty are expressed in the fact that during it the convicted person engages in useful social work without pay and thereby compensates for his sin before society. This punishment has punitive consequences and acts as a measure of correction of the convicted person. The content and essence of compulsory work as a criminal penalty are simultaneously expressed by its characteristics and features. The author's research shows that work is a means of correcting a convicted person. Thanks to work, the process of reforming a convicted person is carried out in the spirit of respect for the interests of society, the development of work skills and qualities such as discipline, honest behavior and compliance with the law. It should be taken into account that labor is an abstract scientific concept; it does not exist only in the form of a pure concept.
