The article attempts to study one of the most important pages in the formation and development of Islamic law, which still remains practically unexplored. This is the process of the origin and development of Muslim unwritten and written law. From the standpoint of theoretical and historical-legal analysis, the features of the formation of Muslim unwritten law at the beginning of the 7th century are comprehended in detail, the main sources of Muslim law are the Koran and Sunnah, and their role in the genesis of Muslim unwritten and written law is shown. The leading role of Islamic judges-qazis, have been studied in the development of the culture and traditions of Muslim unwritten and written law and also the place and significance of Islamic legal schools in the formation and subsequent development of Muslim written law – fiqh as well.
