TO THE ISSUE OF THE REASONS WHICH ENGENDERED LAW SCHOOL IN ISLAM

Abstract

The author of the article takes an endeavor of researching one of the most important pages in the history of formation and development of Moslemic law connected with an appearance of law schools. The process of engendering of Moslemic law schools – mazhabs – is considered under utterly new methodological positions, an attempt is undertaken to comprehend the issue in question in connection with general world regulations of law emergence and affection of cultural-historic factors, customs and traditions. In this streamline genesis of rationalists` law schools in Iraq and traditionalists` ones in Hijaz are subjected to comparative study; there were comprehended distinctions in their genesis and nature associated with mentality, culture, psychology, consciousness, rights, every-day life; ethnographic, geographic and climatic peculiarities of the regions where the process of law schools engendering took place being taken into account as well.
