On the Issue of Legal Nature Concerned with “Computer Programme” Category

Abstract

The article dwells on the problem of legal nature concerned with computer programmes. Legislative securing of the definition “computer programme” in Tajikistan Republic is elicited. The terms “computer programme” and “programme security” are correslated. Peculiarities of computer programmes as an object of author’s right are canvassed. Legal means in reference to authorship and patent are analyzed. It is underscored that the basis of computer programmes is laid down with algorythms, i. e., with succession of certain operations realized in an established order; this peculiarity from the very beginning presented an essential hindrance for effectuation of the designed system of protection implementation.

The author made a number of conclusions being of scientific and practical importance. She conducted a research of the algorythms dealing with the following items: programme used for translation into one of the languages of programming, programme interface for users, initial text, attendant material, documentation of objective code. Each of the objects enumerated enjoys self-sufficient significance and can exist irrespective of others.
