The author of the article analyzes the correlation of «victim» concept according to penal legislation of Tajikistan Republic and Russian Federation. The research resulted in well-grounded suggestions on an improvement of penal legislation of Tajikistan‚ introduction of amendments and addenda into RT PC. In the author`s opinions‚ for example‚ it is expedient to acknowledge a person as being a victim concurrently with starting criminal procedures on a case‚ as the former as an active participant of the latters in bound to be granted with rights which should be ensured alongside with legitimate interests already at an early stage of case investigation. It is suggested that the following amendments and addenda should be introduced into the first part of article one of RT PC concerned with a victim: a) to substitute the term «property» for the term «material»; b) to substitute the word-combination «business reputation» for the term «moral».
