Мафҳум ва таснифи кафолатҳои хизматчиёни давлатӣ дар Ҷумҳурии Тоҷикистон мавриди баррасӣ қарор гирифтааст. Исбот шудааст, ки кафолатҳо яке аз унсурҳои калидии мақоми ҳуқуқии хизматчиёни давлатӣ ба шумор мераванд. Нуктаи назари олимони ватанӣ ва Русия, ҳамчунин муқаррароти дахлдори санадҳои меъёрии ҳуқуқии амалкунанда дар бораи кафолат дар хизмати давлатӣ таҳлил карда шуданд. Гуногун¬ҷабҳагии мафҳуми “кафолати хизматчиёни давлатӣ” муайян карда шуда¬аст. Тасни¬фоти мухталифи кафолатҳо дар хизмати давлатӣ пешниҳод гардидаанд. Дар асоси муқаррароти Қонун № 233 аз 5 марти соли 2007 «Дар бораи хизмати давлатӣ», тасни¬фи кафолати хизматчиёни давлатии Ҷумҳурии Тоҷикистон таҳия шудааст. Пешни¬ҳод шудааст, ки санади меъёрии ҳуқуқӣ дар бораи ҳавасмандгардонии хизматчиёни давлатӣ бо назардошти вазифаҳои муосир ва шароити амалкарди хизмати давлатӣ дар Ҷумҳурии Тоҷикистон таҳия гардад.
